On Sunday, April 01, 2018, at approximately 10:00 p.m., the Palo Alto County Sheriff’s Office arrested Christopher Smith (38), of Emmetsburg, on a valid Palo Alto County warrant. The warrant stems from original charges including: three counts of possession of a controlled substance with intent to deliver more than 5 grams of methamphetamine= class B felonies; one count of neglect or abandonment of a dependant person= class C felony; one count of possession of a firearm by a felon= class D felony; and one count of used or expired drug tax stamp= class D felony. Bond was set in the amount of $75,000.00 cash or surety. Smith was being held by Clay County Sheriff’s Office and was transported to the Palo Alto County Jail, without incident. Smith was unable to post bond and was subsequently booked in to jail to await his initial appearance before a magistrate.
A criminal charge is merely an accusation and the defendant is presumed innocent unless and until proven guilty in a court of law.
