On 2/27/2016 at 5:36 p.m., The Palo Alto County Sheriff’s Office received an emergency phone call regarding a disturbance in the 3800 block of 460th Avenue. Upon an investigation conducted at the scene, The Palo Alto County Sheriff’s Office arrested Christopher Allen Devary, age 23 of Graettinger, for Domestic Abuse Assault. Devary was transported to the Palo Alto County Jail on the serious misdemeanor charge and held until his initial appearance before a magistrate.
On 02/27/2016 at 5:00 p.m. the Emmetsburg Police Department and Palo Alto County Sheriff’s Office conducted a traffic stop in the 2400 block of Main Street in Emmetsburg. Following the traffic stop the Palo Alto County Sheriff’s Office arrested William Allen Murray, 60, of Emmetsburg on a valid Palo Alto County warrant for contempt of court on failure to pay child support. Murray was unable to post the $500.00 cash only bond. Following Murray’s arrest a search of his person was conducted. A controlled substance and drug paraphernalia were located. Murray was subsequently charged with Possession of a Controlled Substance 3rd Offense, a Class “D” Felony and Possession of Drug Paraphernalia, a simple misdemeanor. Murray was later booked into the Palo Alto County Jail to await his initial appearance before the judge.
On Wednesday February 24, 2016 the Palo Alto County Sheriff’s Office investigated a report of an underage party at 3484 440th Ave. northwest of Emmetsburg, IA. At 10:46pm deputies with the Sheriff’s Office discovered a large group of people at the residence. It was discovered that twenty people were under the age of 21 and consuming alcohol. All individuals that were found to be consuming alcohol were cited for Possession of Alcohol Under the age of 21, which is a simple misdemeanor.
The following people were cited by deputies for Possession of Alcohol: Andrew Quail from Everly, IA; Jared Hinkeldey from Galva, IA; Lance Gruhn from Manning, IA; Chase Paulson from Armstrong, IA; Cassidy Hanson from Emmetsburg; Jacob Govern from Ledyard, IA; Nicholas Chapman from Ruthven, IA; Bryce Harris from Armstrong, IA; and Austin Delong from Emmetsburg; Dillon Delong from Emmetsburg; Tristan Johnson from Van Wert, IA; Jessika Gustin from Dickens, IA; Benjamin Henning from Adrian, MN; Jordan Henry from Madelia, MN; Matthew Bennett from Marshall, MN; Morgan Riessen from Spencer, IA; Hunter White from Greenville, IA; Blake Solsma from Sanborn, IA. One 17 year old was referred to juvenile court.
Austin Delong (19) was also cited for Providing Alcohol to Minors.
Over the last 6 months the Palo Alto Sheriff’s Office and other area law enforcement have been monitoring the activities of certain individuals believed to be contributing to the illegal distribution of marijuana in Palo Alto County as well as other surrounding communities. On Friday February 19, 2016 the Palo Alto County Sheriff’s Office made a traffic stop directly tied to this investigation. At 1:00 am a 2005 Chevrolet Monte Carlo was stopped just east of Ruthven, Iowa on 370th Ave. The vehicle was intercepted on it was back from Colorado.
A passenger in the vehicle, Madalyn Gene Schattschneider DOB: 01/29/1997, had been the object of multiple controlled marijuana buy operations conducted by the Palo Alto County Sheriff’s Office. Prior to this traffic stop on the 19th, Deputies obtained an arrest warrant for Schattschneider for Delivery of Marijuana which is a Class D Felony.
During the traffic stop, marijuana and other drug related materials were discovered in the Monte Carlo. The two male individuals in the vehicle were placed under arrest and transported to the Palo Alto County Jail along with Schattschneider. The Monte Carlo was seized and towed to a secure location by the sheriff’s office. Palo Alto County Deputies applied for a warrant to search the Monte Carlo. After a judge granted the search warrant, Deputies along with the assistance of Palo Alto County’s Drug Detection Canine, searched the Monte Carlo. Approximately 6 Pounds of Marijuana was located in the vehicle along with a large number of other marijuana products purchased in Colorado.
Deputies seized the marijuana, drug equipment, other marijuana products as well as the 2005 Monte Carlo. Grant Alan Potter (18) from Estherville, Iowa, Madalyn Gene Schattschneider (19) and Joseph Douglas Wildin (20) both of Algona, Iowa were all charged with Possession of a Controlled Substance with the Intent to Deliver, a Class D Felony, Drug Tax Stamp Violation, a Class D Felony, Conspiracy, a Class D Felony, and Possession of Drug Paraphernalia, a Simple Misdemeanor. All three were booked into the Palo Alto County Jail to appear before a judge. Schattschneider’s arrest warrant for Delivery of Marijuana required a $10,000 cash only bond.
The Palo Alto County Sheriff’s Office along with other area law enforcement agencies are continuing the investigation into the illegal drug distribution in our communities and more arrests are expected.
On February 2, 2016 at 3:00pm, the Palo Alto County Sheriff’s Office arrested Timothy L. Shultz of Spirit Lake, IA on a warrant for Contempt of Court. Shultz was transported to the Palo Alto County Jail where the $500.00 cash bond was posted. Shultz was given a court date and released.
On February 7, 2016 at 10:15am, after a complaint of suspcious male at 1301 Center St, Ruthven, the Palo Alto County Sheriff’s Office arrested Kelly R. Kress (54) of Spencer for Public Intoxication and Disorderly Conduct. Kress was transported to the Palo Alto County Jail to await his intial appearance before a judge.
On 2/18/2016 at 6:44 p.m., the Palo Alto County Sheriff’s Office cited Larry Alan Prince, age 67 of Ruthven, for allowing an animal to run at large within the corporate city limits of Ruthven. Prince was summoned/cited for the simple misdemeanor violation and released on his promise to appear at a later date.
On Wednesday, January 17th, 2016, at 11:30 p.m., the Palo Alto County Sheriff’s Office arrested Tyler Coakley, 21, of Ruthven on a valid Palo Alto County warrant. The warrant stems from a charge of permitting an individual under the age of 18 to consume or possess alcohol; simple misdemeanor. Coakely was unable to post the $650.00 bond and was booked into jail to await his initial appearance before a magistrate
On 2/16/16 at 5:42 p.m., the Palo Alto County Sheriff’s Office arrested Tony Marion Alberson, age 43 of Moline, IL, on a valid Palo Alto County warrant for Failure to Appear (contempt of court). Alberson was transferred from Scott County, IA to the Palo Alto County Jail, without incident and held on the $500.00 cash only bond.
On Friday February 12, 2016 at 10:23pm the Palo Alto County Sheriff’s Office responded to a motor vehicle accident at the intersection of 310th St. and 450th Ave. north of Emmetsburg.
A 2003 Ford Ranger, driven by Nathan Timothy Schiek (17) of Emmetsburg, IA, was lodged against a utility pole at this intersection. Schiek drove through the T-Intersection of 450th Ave and 310th St. and collided with a utility pole. The pole broke away from the ground and rested against the truck. Utility crews were paged and the pole was fixed. The truck sustained an estimated $3000 damage and the utility pole damage is estimated at $1000. There was a county road street sign damaged also and the estimated cost of repair is $100.
Schiek was determined to be under the influence of alcohol while driving and was placed under arrest for Operating While Intoxicated, a serious misdemeanor and was also cited for Failure to Maintain Control which is a simple misdemeanor. Schiek was released to the custody of his parent.
