Accident

On 08/10/2015 at approximately 2:25 p.m. the Palo Alto County Sheriff’s Office was notified of a one vehicle accident that occurred in the 4500 block of 460th Avenue. At around 5:30 a.m. a 2004 Chevy Trailblazer driven by Tracy Dawn Lyon of Mallard was northbound in the 4500 block of 460th Avenue when she struck a deer that had entered the roadway from the east ditch. Damage to the Chevy is estimated at $1,800.00. No injuries were reported.

Simple Domestic Abuse Assault

     

 

On 08-09-15 at around 12:18 a.m. the Palo Alto County Sheriff’s Office received a report of a domestic assault that occurred in Graettinger. The Palo Alto County Deputies conducted an investigation and following the investigation, Kay Lynn Thayer of Emmetsburg, was arrested and charged with a simple domestic abuse assault.

 

She was transported without incident to the Palo Alto County Jail where she was placed in jail to await her appearance before the magistrate.

 

 

Arrest

On Friday, August 07, 2015, at approximately 5:55 p.m., the Palo Alto County Sheriff’s Office arrested John Dale Metzger, 55, of Whittemore on valid Palo Alto County warrants. The warrants stem from an incident on July 31st, 2015, in which the Palo Alto County Sheriff’s Office investigated a complaint of an aerial spray plane being shot at with a firearm in Palo Alto County. Metzger is charged with terrorism= a class B felony; intimidation with a dangerous weapon= a class C felony; stalking with a dangerous weapon= a class D felony; and going armed with intent= a class D felony. Metzger was transported, without incident, to the Palo Alto County Jail. Metzger was unable to post bail, which was set at $25,000 cash or approved surety and was booked into the Palo Alto County Jail to await his initial appearance before a magisterate.

Vehicle Accident

On Sunday, August 2nd, 2015, at approximately 7:30 p.m., the Palo Alto County Sheriff’s Office received a complaint of a one vehicle accident at the intersection of 490th Street and 545th Avenue. Following an investigation into the accident, it was determined that Mitchell Carroll, 21, of Corwith was driving a 2005 Ford Taurus eastbound in the 5400 block of 490th Street. Carroll was following other vehicles while he was approaching the T intersection at 545th Avenue and 490th Street. Due to dust in the air from other vehicles, Carroll was unable to see the intersection and slow his vehicle to negotiate the intersection. Carroll attempted to turn southbound onto 545th Avenue, but lost control of the vehicle. Carroll’s vehicle slid sideways into the east ditch. Once entering the ditch, Carroll’s vehicle rolled 3/4 of a roll and came to rest on the passenger side of the vehicle.

 

Carroll and two other passengers fled the accident scene. Carroll’s two passengers, Rachel Wirtz, 18, of West Bend along with a juvenile passenger were both transported by private vehicle to the Algona Hospital to be treated for serious injuries sustained in the accident. Carroll was not injured and did not seek medical attention. Carroll’s vehicle was deemed a total loss in the accident. Following the investigation, The Palo Alto County Sheriff’s Office cited Mitchell Carroll with failure to report a personal injury accident, failure to obey a stop sign, and failure to maintain control of a vehicle= all simple misdemeanors. The Palo Alto County Sheriff’s Office also cited Rachel Wirtz for minor in possession of alcohol, a simple misdemeanor.

Palo Alto County Search Warrant

On 07/31/2015 at approximately 10:25 a.m. the Palo Alto County Sheriff’s Office was contacted in reference to an individual shooting at an aerial spray plane owned by Steier AG Aviation of Whittemore, Iowa, while it was conducting routine spraying of a field in Palo Alto County. Upon further investigation, it was determined that the incident took place in the south west corner of section 25 in Fairfield Township while the plane was spraying a farm field. The plane was struck on the right wing flap by a bullet and was able to return to the landing strip and land safely.

 

During the investigation a suspect was developed and a search warrant was obtained for a property located at 5719 390th Street. Several items were seized from the property and are in the process of being analyzed. There have been no arrests made in the case and the investigation is ongoing.

 

The Palo Alto County Sheriff’s Office was assisted in the investigation by the Federal Bureau of Investigation, Kossuth County Sheriff’s Office, and Algona Police Department.

Possession of Alcohol Under Legal Age

On 8/1/2015 at approximately 10:43p.m., the Palo Alto County Sheriff’s Office conducted a traffic stop in the 3600 block of 360th St. Upon an investigation into the traffic stop, four(4) subjects were charged with minor in possession of alcohol under the legal age. Darby Gillian Jones, age 19 from Spencer, IA was charged with possession of alcohol under legal age. Jones was also given a written warning for speed. Hannah Jaye Mitchell, age 18 from Milford, IA was charged with possession of alcohol under legal age. Tye Aaron Sanders, age 18 of Milford, IA was charged with possession of alcohol under legal age. A fourth subject, a juvenile under the age of 18 yrs of age, was also charged and referred to juvenile court services. Jones, Mitchell and Sanders were cited and released with a court date of 9/23/2015.

Arrest Warrant Served

On 07/31/2015 the Palo Alto County Sheriff’s Office arrested Trent Michael Truelson, 23, of Pocahontas on a valid Palo Alto County Warrant for Assault causing bodily injury, a serious misdemeanor. Truelson was unable to post the $1,500.00 cash only bond and was later booked into the Palo Alto County Jail to await his initial appearance before a judge.

Arrest Warrant Served

On 7/29/15 the Palo Alto County Sheriff’s Office arrested Patrick Keith Johnson (46) of Curlew on a valid Palo Alto County Warrant for Driving While Barred an Aggravated Misdemeanor. Following his arrest, Johnson was unable to post the $6500.00 cash or surety bond and was booked into jail to await his intial appearance before a judge.

Assault

On Monday, July 27, 2015, at approximately 5:54 p.m., the Palo Alto County Sheriff’s Office received a call of an assault in progress at Sparky’s Convenient Store, in Mallard. Following an investigation into the incident, the Palo Alto County Sheriff’s Office arrested Aaron Krusen, 26, of Mallard for assault causing bodily injury= serious misdemeanor, and driving while suspended. Krusen was transported to the Palo Alto County Jail, without incident, and booked in to await his initial appearance before a magistrate.

 

The Palo Alto County Sheriff’s Office has an ongoing investigation into this incident and more charges are pending on the second party involved.

Asphyxiation

On 7-25-2015 at 1:50 p.m., the Palo Alto County Sheriff’s Office received a call that two males were submerged in a hog manure pump pit at 3268 510 Ave. Fire Departments from Cylinder and Emmetsburg were dispatched as well as two Palo Alto County Ambulance from Emmetsburg.

 

Upon Sheriff’s Office arrival, Gene Opheim, age 58 of Cylinder, Ia., was pulled from the pump pit and life saving measures began. Austin Opheim, age 32 of Cylinder, was extricated from the manure pit by fire personnel and life saving measures began. Gene and Austin were transported by ambulance to the Palo Alto County Hospital and both succumbed to their injuries.

 

The Opheim’s were making repairs to the manure pit at the time of the incident. Austin had entered the pit and was overcome by gases contained in the pit. Gene entered the pit in the attempt to rescue his son.
