On Tuesday, September 29, 2020, at 3:52 pm, the Palo Alto County Sheriff’s Office responded to a motor vehicle accident at the intersection of 380th Street and 470th Avenue. Following an investigation into the accident, the Palo Alto County Sheriff’s Office determined that Andrew Beenken (36) of Emmetsburg, was driving a 1998 Jeep Wrangler west in the 4700 block of 380th Street. While distracted by means inside of his vehicle, Beenken failed to see a semi directly ahead of him slowing, signalling, and attempting to turn south onto 470th Avenue. Beenken attempted an evasive maneuver in order to prevent a collision with the back of the semi. Beenken was unable to slow his vehicle, which then exited the roadway and entered the west ditch on 470th Avenue, struck an embankment which caused his vehicle to roll once and came to rest on its side.
Beenken sustained minor injuries during the accident. Beenken’s vehicle was deemed a total loss in the accident. The Palo Alto County Sheriff’s Office cited Andrew Beenken with failure to reduce speed to a reasonable and proper rate and failure to provide proof of financial responsibility, which are both simple misdemeanors.
A criminal charge is merely an accusation and the defendant is presumed innocent unless and until proven guilty in a court of law.
