On Saturday June 11, 2016 at 5:21pm, the Palo Alto County Sheriff’s Office was called to the 3400 block of Highway 4, south of Graettinger on a report of a motorcycle accident. Matthew Davis (33) of Graettinger was southbound on his 2003 Yamaha motorcycle and cresting the hill just after the intersection of 340th St. and Highway 4 (420th Ave). Takota Harris (17) of Emmetsburg pulled onto Highway 4 from a driveway at 3410 420th Ave. Harris did not see Davis due to the crest in the road. Harris pulled in front of Davis and as Davis tried to stop he lost control of the motorcycle. The motorcycle entered the shoulder and ditch on its side. Davis fell off the motorcycle and skid across the pavement into the ditch with his motorcycle. Davis is believed to have sustained only minor injuries in the crash.
The Sheriff’s Office checked the sobriety of Davis and he was placed under arrest for OWI and transported to the Palo Alto County Jail.
Davis was booked into the jail and charged with Operating While Intoxicated a Serious Misdemeanor.
A criminal charge is merely an accusation and the defendant is presumed innocent unless and until proven guilty in a court of law.
